1. Acceptance of Terms
By accessing or using the website joestreecarenc.link or placing service requests via phone ((321) 478-0689), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this site or request services through our platform.
2. Scope of Service & Referral Relationship
Race City Tree Crew operates as a referral and marketing platform connecting homeowners, property managers, and commercial clients in Mooresville, NC and surrounding Lake Norman municipalities with independent, qualified, and insured tree care contractors. The independent contractors sent to your site evaluate tree conditions, provide written scopes of work, and perform all physical tree cutting, rigging, pruning, and stump grinding operations.
3. Estimates, Scopes of Work & Pricing
Estimates provided over the phone or submitted via online forms are preliminary and subject to on-site physical inspection by the dispatched crew. A binding written scope of work detailing removal procedures, equipment deployment, crane fees, debris haul-away, and stump grinding must be agreed upon between you and the operating crew leader before cutting begins. All prices quoted reflect clear, honest rates with zero hidden fuel surcharges or disposal add-ons.
4. Property Access & Underground Utilities
Property owners are responsible for granting safe, unobstructed access to the work area, including opening gates, unlocking fences, and moving vehicles. For stump grinding or excavation, public utility clearance is initiated through NC811. However, homeowners are strictly responsible for notifying crews of private, unmapped underground infrastructure, including lawn irrigation lines, invisible dog fences, low-voltage landscape lighting, septic drain fields, and buried power conduits running to docks or outbuildings. Dispatched contractors are not liable for damage to unmapped, undisclosed private utilities.
5. Weather Delays & Safety Rescheduling
Tree dismantling and aerial crane operations involve severe inherent hazards. For the safety of the crew and your property, tree work may be postponed or rescheduled due to adverse meteorological conditions, including high wind gusts (exceeding 25-30 mph), heavy rain, lightning within a 10-mile radius, or freezing ice accumulation. Safety-related rescheduling will be communicated promptly.
6. Emergency Storm Operations & Insurance Billing
During widespread severe weather disasters, dispatch prioritization is given to active structural breaches, trees resting on occupied residences, and blocked primary driveways. While crews provide insurance-compatible itemized estimates complying with Xactimate billing codes, property owners remain responsible for authorized work in the event their insurance carrier denies coverage or applies unexpected deductibles.
7. Municipal Permits & Environmental Buffers
While our participating crews assist with local municipal guidelines (such as Davidson Section 9 tree permits or Duke Energy Lake Norman shoreline buffer rules), final compliance with town ordinances, watershed overlays, and HOA architectural covenants remains the joint responsibility of the property owner.
8. Limitation of Liability & Insurance Verification
Race City Tree Crew dispatches independent contractors. Work is performed under the contractor's independent insurance policy and licensing. Homeowners are entitled and encouraged to request and verify a current Certificate of Insurance (COI) directly from the on-site crew leader prior to the commencement of any work.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal disputes arising out of these terms shall be resolved in the competent courts of Iredell County, North Carolina.
